Australian Tour Conditions

Please read these Booking Conditions very carefully as they form the basis upon which GARUDA ORIENT HOLIDAYS PTY LTD (referred to hereafter as GOH) accepts bookings.

Changes in Prices and Itineraries

Should the price of your holiday be affected by changes to flight schedules, tax/surcharge increases, currency fluctuations or increases in third party costs, GOH reserve the right to adjust your prices accordingly, even after you have paid all or part of the quoted price of your holiday.

If we need to change your booking or part of it for reasons beyond our control –for instance if airline timetables change or a hotel advises an overbooking situation –we reserve the right to vary your itinerary and will give you, or cause to be given to you, prompt notice thereof. In the event that any one change or series of changes to your holiday itinerary demonstrates that your holiday has thereby become materially different from that contemplated prior to the change or changes effected, and in respect of which we have already accepted your deposit or balance payment, you have the right to withdraw from the holiday and monies already paid will be refunded in full, less any non-refundable airline, hotel or ground operator charges. Alternatively, with your agreement, we will rearrange your holiday by providing alternative arrangements of the same or similar standard as originally booked.

In the unlikely event that we have to cancel your booking because of events outside our control we will, if we are able to, offer you an alternative holiday of similar standard. If you do not accept the alternative, we will refund in full any monies already paid, less any non-refundable airline, hotel or ground operator charges.

Holiday prices are based on tariffs and exchange rates current as at 1st February 2009. In this time of escalating prices and economic instability, it is impossible to accurately foreshadow fluctuations in exchange rates or increases in airfares, fuel, airport charges, hotel rates and other service providers’ tariffs. If your holiday price increases by more than 10% you will have the right to cancel within seven days of notification of the surcharge without penalty.

What ’s included in your “Bali on ANY budget” holiday

Your “Bali on ANY budget” holiday is defined as a package which may include a Garuda Indonesia international airfare, return airport/hotel transfers and prepaid inclusive tour, cruise or sleeping accommodation in commercially operated hotels/motels for the total duration of your holiday.

 

The GOH website offers three different options. The ‘Holiday Packages’ options are ready made packages including airfares & taxes, transfers, accommodation and specified tours, that have been featured and promoted in GOH promotional product flyers. The ‘Design Your Own Holiday’ option allows you to create your own package including airfare & taxes, transfers, accommodation and tours, that are available from the GOH website. The ‘Hotels’ option allows you to book accommodation and tours that are available from the GOH website.

Prices and Payments

All prices featured in our website are per person in Australian dollars. For alternative currencies please use the “Currency Converter” option. Prices advertised are generally on a “share twin” basis unless specifically stated otherwise. For Single, Triple, Child, Family and other pricing options please refer to the booking calculation screen.

 

GOH has made every effort to ensure the information and pricing supplied in this website is accurate and publishes it in good faith. Changes to hotel facilities, features or rates may occur without notice and will be updated promptly. GOH do not accept liability for any inaccuracy in, or departure from what is described in the website.

 

Full payment is required at time of booking.

Booking Arrangements

A firm contract will exist between yourself and GOH when your booking and full payment has been processed through the GOH website. If you make the booking on behalf of other persons, your booking shall be taken as acceptance of the Booking Conditions by each person named by you. The contract will be governed by and subject to the Terms & Conditions and general information contained in the website. No variation of the Terms & Conditions shall be of any effect, unless made in writing and with the authority of GOH. GOH shall, on the receipt of your holiday monies, hold such monies for each person named in the booking, and all such monies received by GOH are, as required by law, deposited on your behalf into trust accounts maintained in our name. We are entitled to keep any interest earned on such monies. It is a condition of our booking confirmation that we may distribute such monies towards the cost of services and fees inherent in your holiday, and that your payment of monies shall represent a direction by you to us, to disburse such monies accordingly.


Late Bookings

Late bookings can only be accepted if the airfare, accommodation and other required arrangements are showing available in the GOH website. Bookings made within 7 days of departure can not be made on the GOH Website.

Amendments

Should you need to make any changes to your itinerary, departure date, hotel or room type, or any substitution or reduction to the passengers booked you must contact GOH directly via email or phone. An amendment fee of $50 per booking file per change (payable at the time of amendment) will be payable, plus any cost differential between the original booking and amended components. An amendment fee of $50 (payable in Bali) will be payable, plus any cost differential between the original booking and the amended components, for any amendments made on your behalf while in Bali (for example changing your hotel) Once travel documents including airline tickets have been issued, the following conditions apply (as stipulated by International Airline Regulations):

A $100 fee per ticket applies for reissue of ticket or to make changes before/after departure.

Cancellation/ Refund

Should you or a member of your party be forced to cancel your holiday for any reason, you must contact GOH immediately. The date you contact GOH and inform of any cancellation is the date used to calculate any applicable cancellation charges/refund.

No refund is available on land arrangements

In addition, once airline tickets have been issued, the following fees as stipulated by International Airline Regulations apply:

■ A cancellation fee of $250 per adult, $188 per child, $25 per infant applies if ticket is cancelled prior to departure.

No refund is available once travel has commenced.

Please note that a claim for reimbursement of cancellation charges may fall within the terms and conditions of any Travel Insurance policy you have effected.

 

Cancellation and Refunds in the event of Terrorism

Unused air tickets may be refundable in part or in whole, subject to the conditions imposed by the airline.

Consumer Claims

If you are unhappy about any aspect of your GOH arrangements whilst you are on holiday, you must contact the GOH Bali office as your contract is with GOH not any other 3rd party (or our local representatives elsewhere) and they will do everything possible to resolve the matter on the spot, since it may prove difficult to take any further action once you have completed your holiday. If, however, the matter cannot be resolved during your holiday, please contact GOH Australia within 30 days after your holiday arrangements have concluded outlining the nature of your complaint. GOH are unable to consider any consumer claims received more than 30 days after your holiday arrangements have concluded.

Travel Advisories

We strongly recommend you check with the appropriate authorities for information on current Travel Advisories that may apply to your holiday destination before booking and departure. Australian Department of Foreign Affairs & Trade Travel Advisories are available at www.smartraveller.gov.au  

Travel Insurance

GOH require, and strongly advise that, at the time you book your holiday, you purchase comprehensive Travel Insurance. For your own protection the Travel Insurance should include the following protection and features:

■ Loss of deposit through cancellation Personal baggage and loss of money

■ Personal Baggage and loss of money

■ Medical expenses

Additional expenses to cover hotel accommodation and repatriation costs should the holiday need to be extended or curtailed due to illness, or due to the need to return home because of unexpected death or illness of a close relative. This feature should also cover cancellation of transport services due to industrial action. You will be responsible for arranging your own travel insurance. GOH can provide suitable travel insurance – please ask for details. Should you decline to purchase Travel Insurance, GOH cannot be held liable for costs incurred from subsequent unforeseen circumstances which may arise. It is essential to ensure that you advise GOH of a telephone number where you can be reached within 24 hours prior to your holiday departure.

Travel Documents

All visitors to Indonesia must be in possession of a Passport valid for at least 6 months beyond the date of arrival in Indonesia. Australian residents who do not hold an Australian passport will require an Australian re-entry visa. All Australian and New Zealand passport holders must obtain a visa on arrival at Denpasar (Bali) and selected other airports and seaports (currently US$25 for 30 day visa, but subject to change without notice). Citizens of other countries may need to obtain a visa prior to arriving into Indonesia – it is your responsibility at all times to check with the relevant authorities what requirements apply at the time of your travel.

Not included in the cost of your holiday

Interstate/intrastate passengers are responsible for the cost of their own travel arrangements from their hometown to their choice of international departure city and return. Passengers originating in countries other than Australia are responsible for all transportation costs and arrangements to and from Indonesia. The cost of any accommodation in Australia, passports and visas where required, and airport taxes where applicable are not included in the holiday price; nor are items of a personal nature such as meals (unless otherwise stated), laundry, telephone calls, travel insurance, gratuities or excess baggage charges.

Air Travel

Participating carrier in these holidays is Garuda Indonesia. However, it may be necessary to use the services of other airlines in certain circumstances. The participating carrier does not by virtue of being referred to in this website endorse the website.

Baggage

The free baggage allowance for international air travel on Garuda Indonesia is 20kg for Economy class and 30kg for Executive class. Some domestic carriers impose stricter baggage restrictions on smaller aircraft, as do some ferries or cruise operators (please ask for details).

Useful Hints Concerning Your Health

The Australian Department of Health recommends that tourists visiting Asia be vaccinated against hepatitis, cholera and typhoid. Changes in diet can sometimes cause minor stomach upsets, so we recommend you consult your doctor about reliable preventatives. Minor stomach upsets and heat related illness can be prompted and/or exacerbated by dehydration, so a steady consumption of bottled water is recommended. In any tropical climate there is the possibility of contracting malaria, we therefore recommend you seek your doctor’s advice as to the appropriate medical precautions which may be necessary for the areas you plan to visit.

Photographs

Care has been taken to feature images of accommodation and services as quoted in the website, however in some cases a hotel may have differing configurations and standards within the same room category. Images of accommodation and services are provided by suppliers but are only intended to be representative and may not specifically reflect the room type, configuration,  bedding or other service booked.

Requests for double beds and specific rooms

Any requests for double beds, specific room types, specific room numbers or specific aircraft seating cannot be guarantee, nor does GOH accept any responsibility for any such requests. These requests are always subject to availability upon check-in.

Bungalow /Cottage Accommodation

While some accommodation suppliers may promote themselves as offering cottage or bungalow style accommodation, they may in fact offer a range of accommodation types which may or may not all be in the stated style. If you are seeking a specific type of accommodation it is your responsibility to ensure the desired style is clearly requested at time of booking, and to check and ensure such request is stipulated on the accommodation voucher prior to departure.

Extra Beds and Triple Share

The number of adults and/or children permissible in a room does not necessarily reflect the number of beds in the room. It simply indicates the number of adults and/or children a hotel will allow to share on existing bedding (which may not always be comfortable or appropriate) or on extra beds (whether free or charged). In many cases extra beds (usually a rollaway or foldaway bed which is substantially smaller than a standard single bed) are available at an additional charge. Some hotels will allow children to share with adults on the existing bedding which may only be a twin or a double bed, and in these instances extra rollaway beds may not be provided. In most cases “triple share” basis will consist of the existing bedding (whether one double bed, or two twin beds) and an extra bed (usually a “rollaway” or “foldaway” bed). In some hotels (generally budget properties) however, the ‘extra bed’ or third bed in a triple share, may only be a mattress placed on the floor. In most cases, the placement of a third bed is usually at the expense of floor space. Where children are permitted to share their parents’ room, unless specifically stated as “free” (eg ”free on extra bed”), the cost for an extra bed (or mattress) will automatically be charged for. So as to avoid discomfort through misunderstanding, GOH will usually include the cost of a child extra bed in your booking unless it is provided free by the hotel.

Our Responsibility

GOH is not itself a carrier or hotelier, nor do we own aircraft, hotels or coaches. The flights, coach journeys, other travel and hotel accommodation in your holiday are provided by reputable service providers on their own conditions. Please note that all bookings with GOH are subject to the terms and conditions and limitations of liability imposed by these service providers, including but not limited to shipping, rail, car hire and restaurants, whose services we utilise, some of which limit or exclude liability in respect of death, personal injury, delay and loss or damage of baggage.

GOH will always do our best to make sure your holiday arrangements are satisfactory and we accept liability for, but only to the extent of, any loss or damage sustained by you as the result of our negligence or that of our employees or Agents. However, we cannot accept any liability of whatever nature for the acts, omissions or defaults, whether negligent or otherwise, of those airlines, coach operators, shipping companies, hoteliers or other persons providing services in connection with your holiday pursuant to a contract between themselves and yourself (which may be evidenced in writing by the issue of a ticket, voucher, coupon or the like) and over whom we have no direct and exclusive control. We do not accept any liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly by force majeure or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God or Government or of any authorities, accidents to or failure of machinery or equipment or industrial action (whether or not involving our employees and even though such action may be settled by according to the demands of a labour group). Should GOH be found liable in relation to the supply of services then such liability shall be limited to the re-supplying of services or the costs relating to re-supply. Such services will be restricted to that part of the travel to which the liability relates.

Law of the Contract

The contract between you and GOH is governed in all respects by the law of the State of New South Wales, Australia and you hereby submit to the jurisdiction of the courts of New South Wales which shall have exclusive jurisdiction to determine any dispute touching or concerning the contract. Garuda Indonesia does not, by way of its inclusion in this website, represent itself as either contracting with any purchaser of a holiday from GOH, or as having any other legal relationship with any purchaser.

Validity

Every effort has been made to ensure that the contents of this website are accurate on an ongoing basis. Unless otherwise stated, prices for all holidays and tours contained in this brochure are valid for travel commenced and completed between 1 April 2010 and 31 March 2011

Goods and Services Tax

All prices include Goods and Services Tax (GST) where applicable.
